Terms & Conditions

This Agreement by and between Housing Urban Management LLC hereinafter known as “the Company” having an office at 1629 K St NW Suite 300, Washington, DC 20006 and the Housing Provider (hereinafter known as “the Customer, Ownership or Management”). *

I agree

1. RENTAL TERMS. All parties agree that the commission is to be an amount equal to 100.00% of one month’s rent. Full payment is due within (7) days of the lease start date.

A 50% discount will be applied if commission is paid in full within (3) days after the lease start date, thus making the commission equal to 1 month's rent.

A) 50% discount will be applied if commission is paid in full within (3) days after the lease start date. *

B) 33% discount will be applied if commission is paid in full between 4-21 days after the lease start date. *

C) Discounts will not be applied if commission is not paid on or before the 21st day after the lease start date. *

2. LEASING COMMISSION. The commission is earned upon tenant approval, but is due within (21) days of the lease start date (see RENTAL TERMS). *

A) The Company will issue a written notice if the leasing broker determines the Customer is obstructing the deal from progressing by: i. being unresponsive; ii. failing re-inspections after receiving the inspection report with the HQS violations listed from the initial inspection; iii. not complying with HUD’s requests as communicated by the Company; iv. Not acting in good faith *

B) In the event that the Customer fails to comply with (HUD’s) Housing Urban Development’s requests after receiving written notice from the Company, the commission is due within (21) days from the date that notice was sent (see RENTAL TERMS). *

3. PROCURING CAUSE. The Company will issue a written notice requesting commission payment due immediately if the leasing broker discovers that the Customer has contacted and approved an applicant sent by the Company whom the Customer declined within the last 180 days. *

4. PAYMENT METHOD. The Company accepts payment via ACH or other electronic interface methods that directly exchange funds between the Customer's and the Company's bank account. *

The Company reserves the right to modify or update the accepted payment methods at its discretion, provided the Customer is notified in writing of any changes.

5. NON-PAYMENT REMEDIES. The Company will begin collection activities on the thirtieth day after lease signing in the event that the commission is not paid. Legal/administrative fees of $2,500 will be assessed to the outstanding balance with the enforcement of this agreement. *

6. AUTOMATIC DEFAULT JUDGMENT. The Company will be entitled to an automatic default judgment for the leasing commission, legal fees and administrative costs in the applicable court. *

7. AGREEMENT PERIOD. This is an open-end agreement without an end date. This includes any and all rentals leased by the Company. *

8. TERMINATION. Either party may terminate this agreement at any time and for any reason prior to tenant approval. *

9. INITIAL PAYMENTS. The Customer is aware that the initial payment (security deposit and first month's rent) is typically received in 15-30 days after lease signing and move-in. The lease signing and move-in must be completed and the paperwork submitted to the Housing Subsidy Provider i.e. DCHA in order for the payment to be released. *

A) The security deposit is oftentimes paid by the Housing Assistance Program (HAP) or other Emergency Rental Assistance Program (ERAP). Application for security deposit assistance is made by the tenant at the time of tenant approval; however, the security deposit application IS NOT ALWAYS approved. The leasing commission is not contingent upon receipt of security deposit or initial rent payment. *

B) Initial payments are made via direct deposit from the Housing Subsidy Provider (HSP) to the Customer around the 1st and 15th of each month. In order to receive the initial payment around the 1st, leasing documents must be submitted to the HSP between the 11th and 24th. Payment will be received around the 15th if leasing documents are submitted between the 25th and 10th. *

10. LOSS PREVENTION. The Company is not responsible for vandalism, theft or damage to the property or personal belongings left on the property. The Customer is to maintain proper fire and extended coverage insurance, including vandalism, malicious mischief and the like, as well as reasonable property damage and personal liability coverage whether or not the house is vacant or occupied. It is the Customer’s responsibility to confirm with their insurance company for appropriate coverage. *

11. AUTHORIZED SIGNATORY. Each person signing this Agreement represents and warrants that he or she is duly authorized and has legal capacity to execute and deliver this Agreement. Each party represents and warrants to the other that the execution and delivery of the Agreement and the performance of such party's obligations hereunder have been duly authorized and that the Agreement is a valid and legal agreement binding on such party and enforceable in accordance with its terms. *

12. SEVERABILITY. If any provision of this Agreement shall be held or made invalid by a court decision, statute or rule, or shall be otherwise rendered invalid, the remainder of this Agreement shall not be affected thereby. *

13. NON-AGENCY BROKERAGE RELATIONSHIP. Customer acknowledges that the Company operates as a transactional broker and this agreement is a non-agency brokerage relationship. A transactional broker is not an agent for either Landlord or Tenant and does not advocate the interests of either party, but is responsible for assisting both parties in closing the transaction. *

The payment for the Plus or the Turnkey (HQS Consulting) is due at the time of tenant approval (and must be paid prior to submitting the LLP-Landlord Leasing Packet to the Housing Assistance Provider). The customer understands that this payment will be charged per lease and not per property. *

14. HQS CONSULTING RIDER. The following charges will be incurred only if the customer exceeds the limits of the services included with the Plus or Turnkey HQS Consulting Plan selected. *

A) $45.00 | Inspection date reset - customer sets an inspection date with the Company, the Company sets the date with the Housing Assistance Provider then the customer cancels the inspection date and requests a later date *

B) $105.00 | Quality control inspection - inspection done upon confirmation that 100% of the HQS repair violations from the inspection report have been corrected *

C) $175.00 | Additional inspection - coordination and completion of the 3rd, 4th or 5th HQS inspection (only the initial, #1HQS and initial return, #2HQS are included in the HQS Consulting Plans) *

D) $375.00 | Landlord Leasing Packet (LLP) resubmission - the HAP-Housing Assistance Provider requests that the LLP is resubmitted due to multiple failed inspections *

E) $45.00 | Lease customizations - the Company’s GCAAR residential lease template is included in the HQS Consulting plans; however, alternate lease agreements and addenda not included in our lease template are considered lease customizations *

F) $0.00 | Security deposit processing - the Company will submit an application for security deposit on behalf of the tenant and if the application is denied, a security deposit payment addendum will be negotiated and signed by the customer and the tenant prior to move-in *

Would you like for us to coordinate and complete any required repairs? *

I am aware that the rate of $65 per billable hour is for project management and repairs. Estimates will be provided and written approval will be required prior to starting projects. Project management consists of a job assessment, supply run, quality control inspections and disbursing payment to the vendor. The rate for repairs will change in the event that specialty 3rd party vendors need to get involved such as plumbers, electricians or roofers. *
